Training Terms & Conditions
 

1. Definitions

"Softek" means Softek Services Limited.
"Customer" means any individual or Company who purchased training or attended training given by or on behalf of Softek.
"Delegate" means any individual, who is to attend a training course, and is either the customer itself or is nominated by the customer.

2. Services Covered

These terms and conditions cover:

(i) Standard courses provided by or on behalf of Softek as public courses at one of Softek’s Offices.

(ii) Customised or tailored courses given by or on behalf of Softek at Softek’s training centre in Birmingham, London, Oxford or at other locations.

(iii) Delegate administration, which is the responsibility of Softek for public courses and private sessions held at Softek’s training centre in Birmingham, London, Oxford or at other locations. The customer is responsible for delegate administration at other sites.

Additional services and conditions individually agreed between the parties shall only be valid after written confirmation by Softek.

3. Bookings

Bookings for training courses can only be considered if they are in writing, either by email, letter, fax or via our website booking form. Each order is accepted on and subject to these terms and conditions by written confirmation of Softek excluding conflicting terms and conditions of the Customer.

4. Payment Terms

Payment for a course is due immediately on booking. In the event that payment is not received 14 days prior to the course commencement, Softek reserves the right to cancel or re-schedule the course booking.

5. Rescheduling or Cancellation By Customer

A course place may be re-scheduled or cancelled 30 days or more days prior to course commencement - and administration charge may apply. All course re-scheduling must be received in writing to Softek within the specified timeframe.

It is not be possible to re-schedule or cancel a course with 30 days or less notice. Therefore, full course fees are non-refundable for cancellation or non-attendance.

If the course is running at a specific site or location requested or agreed with the customer, then any additional costs incurred due to re-scheduling will be charged in full regardless of the number of day’s notice prior to course date.

Instead of re-scheduling a course, the customer may exchange a delegate without additional costs as long as the exchanged delegate meets the pre-requisites published for the course.

In the highly unlikely event that delegates do not pass the examination, optional re-takes are available but may be charged.

6. Cancellation by Softek

Softek will only cancel a course under exceptional conditions due to factors outside of our control (illness, travel cancellations etc) and will endeavour to give the customer as much notice as possible. Liability will be limited to the invoice value of the course or the offer of a rescheduled date.

7. Delegate Preparation

Delegates should be properly prepared for the course and should understand the published course pre-requisites.

8. Delegate Behaviour

Deletgates are required to act in a reasonable manner throughout the course. Softek reserve the right to remove a delegate from a course where, in the opinion of the presenter, the delegate is behaving unreasonably. Should the incident cause financial loss to Softek, we reserve the right to claim such losses against the delegates company.

It is prohibited for the delegate to copy or distribute any course material. In so far as the customer is responsible for the delegate, the customer will be liable for any breach of this prohibition or other services under the relevant contract.

9. Limitations and Exclusions

Softek shall not be responsible for virus damage caused by unauthorised copying of software/work files by the customer at Softek's training centre or at any other site. Softek staff will take all reasonable steps to safeguard property at customer site, although it must be stressed that the ultimate responsibility is that of the customer. While care will be taken to ensure satisfaction, Softek cannot take responsibility for the quality of hotels suggested or lunch provided during the course.

Any liability of Softek shall be limited to the value of the fee paid for the training or other services under the relevant contract.

10. Applicable Law

This agreement shall be governed by the laws of Jersey and both parties submit to the jurisdiction of said courts.

11. Final Provision

If any of the provisions of these terms and conditions or of the agreement is found to be void or unenforceable the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
